First abortion bill of 2023 introduced in Montana Legislature

Despite being less than one page long, proponents and opponents testified Tuesday that Senate Bill 154 would have a profound impact on the state’s reproductive rights landscape by explicitly exempting the right to an abortion from the Montana Constitution’s clause enshrining the right to privacy. That provision was the foundation of the Montana Supreme Court’s 1999 decision in Armstrong v. State that legalized pre-viability abortion in Montana.
